Terms and Conditions

 

1.Introduction

 

  • This site is operated by the “Israel Experience – Educational Tourism Services Ltd.,” a corporation incorporated under the laws of the State of Israel (“IE“). Your access to the JOBOLIX site is subject to the Terms and Conditions included in this document, which should, therefore, be read carefully. You may not use this site unless you comply with the Terms and Conditions set forth in this document. 
  • These Terms and Conditions form a binding Agreement between yourself and IE. IE may amend this Agreement from time to time. The corrcet version of the Terms and Conditions document is the one posted on the JOBOLIX site.

2. How it works

 

  • The site is a portal for the online distribution and publication of information submitted by the users. IE has no obligation for the advance screening or monitoring of any information posted to the site by users. Nevertheless, in cases where IE identifies any uploaded content which does not conform to these Terms and Conditions, IE may decide, in good faith and in its sole discretion, to remove any such content from the site.
  • Employers who seek to offer employment opportunities are allowed to post job offers on the site, in the format determined by IE. Employers are also allowed to view and download information posted by job-applicants in response to job offers they have posted. Employers may upload, attached to any posted job offer, additional relevant material such as brochures, audio and video files, photographs, and any other relevant documents.
  • Job applicants are allowed to post a personal profile, in the format determined by IE. Applicants may post their profiles in direct response to a specific job offer or in general.
  • All users agree that they are solely responsible for the content of any material they post on the site and any consequences arising from such posting.
  • IE reserves the sole and indisputable right to:
                        • Suspend or terminate the access of any user to the site in case of a breach of the Terms and Conditions and;
                        • Remove, in its sole discretion, any uploaded material it deems inappropriate, having examined such material in good faith.
  • IE grants permission to users to post material on the site in the form of a limited, terminable, non-exclusive license to access the site for personal, non-commercial use directly related to searching for job opportunities or recruiting job-applicants. Users are not allowed to sell, transfer, or assign any material posted by IE and/or other users on the website to any third party without the express written authorization of IE.

3. No Liability, No Endorsement

  • Users agree to use the JOBOLIX platform at their risk and assume full responsibility for their use of the site and the internet in general, including any material they post on the site. 
  • IE will not be liable for any damages which may occur in connection with the use of this site or lack of access to it. Such damages may include direct, indirect, incidental, or consequential damages such as loss of data, loss of reputation, loss of business or income, loss of employment or employment opportunities, or any damage resulting from misrepresented or misleading information posted on the website by any of its users.
  • In cases where the limitation of liability for direct or consequential damages is unenforceable, IE’s liability shall be limited to an aggregate sum not exceeding 150 U.S dollars.
  • To the fullest extent permitted by law, IE makes no guarantees and disclames all warranties regarding the following:
                        • Accuracy, reliability, and legality of posted information;
                        • Accuracy of any other content included in the site;
                        • Effectiveness of the site as a tool for finding employment opportunities or suitable job applicants – IE does not guarantee, in any way, that the use of the site will result in the filling of vacant positions.
  • IE assumes no responsibility for any material posted by users (employers and job applicants alike) and no responsibility for the activities, omissions or other conduct of users. 
  • IE has no liability or responsibility to users of the site for performance or nonperformance the site’s functions.
  • IE is not, nor shall it be liable for any business decisions made by users, including decisions regarding the recruitment or rejection of applicants.
  • Nothing on the site shall be construed as an endorsement, by IE, of any job offer, product, or service.
  • IE uses reasonable efforts to authenticate the identities of users who sign up to the site. However, IE is unable to guarantee that every user is whom they claim to be and will not be liable in cases of fraudulent representation of any user. IE will not be involved in any dealings between users of this site and will not be responsible for any demands, claims, or lawsuits arising out of or connected with their behavior. 
  • IE may, at any given time, without prior notice and in its sole discretion, decide to suspend or permanently terminate the operation of the site and will not be liable for any damages or expenses incurred by any user in connection with such suspension or termination.

4.Intellectual Property

 

  • All materials included in the website, including but not limited to databases, texts, pictures, video clips, data of any sort, graphics and animations, color combinations, algorithms and search engines, titles, slogans, shapes, layouts, designs, marks, trademarks, logos, HTML and source codes are the sole property of IE and protected by Copyright.
  • Unless IE gives its explicit permission in writing, users are not allowed to reproduce, modify, display, sell, or distribute any of said materials, or use them in any other way for public or commercial purposes.

5.Limitations

 

  • The website is intended to be used only as a platform enabling employers and potential job candidates to connect with regard to legitimate job opportunities.

  • The website may be used only for lawful purposes within the scope intended by IE, as explained above. The site is not and may not be used as a platform for the offering of employment opportunities in illegal services of any kind, including (but not limited to) paid sexual services.
  • Users may not use the site as a platform for advertisements or campaigns of any kind.
  • By using the website, users warrant and represent that they are at least 18 years of age. Underaged users are not allowed to use the site.
  • The use of the site by job applicants is strictly personal. By using the site, any job applicant declares that the information is uploaded on their behalf and does not belong to any third party, regardless of whether the third party had given their consent to post information on their behalf.
  • The use of the site on behalf of a corporation should be by officers who, according to the corporation’s articles of association, have been duly authorized to post information in the corporation’s name.

 

6.Privacy and GDPR Compliance

 

  • To the extent that the use of the site involves personal data of job-applicants which is subject to GDPR, the following will apply:

                    • Any personal information collected through the site will be shared with employers solely to enable them to offer employment opportunities to the subjects of said information. 
                    • Any employer, by signing up to the site, warrants and represents that: (1) They fully comply with GDPR and any other applicable data protection laws concerning personal data and; (2) Without derogating from the above they process such personal data fairly and lawfully and only for the purposes for which it was collected (“the Intended Purposes”) and; (3) They store personal data only for the periods necessary for the processing of such data for the Intended Purposes; and (4) They have in place the mechanisms necessary for the immediate erasure of any personal data which is no longer necessary or upon the request of the data subject; and (5) They provide a level of security appropriate to the risk involved in the processing of said data and; (6) They have in place appropriate technical and organizational measures to protect such data against unauthorized use or accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access.
                    • Employers shall refrain from disclosing or transferring personal data collected through the site to any third party unless authorized to do so by the data subject and in compliance with all applicable data protection laws.

 

7.Links to Third Party Sites

 

  • The site may contain links to third party web sites. 
  • These links are provided solely as a courtesy for the convenience of our users. They should not be deemed as an endorsement by IE of the contents of any such third-party sites.

8.Indemnity

 

  • Users undertake to indemnify and hold harmless IE (and its subsidiaries, affiliates, officers, directors, employees and agents) from and against any third-party claims, actions or demands (including, without limitation, costs, damages, and reasonable legal and accounting fees) in connection with the use of the site and any material posted on it.

Opening a personal account, posting  and uploading information

      • Users who sign up to the site will be required to create a personal account and provide certain personal (such as professional training and experience, employment history and preferences) and contact (such as email address and a mobile phone number) information. 
      • Users are not the proprietors of their personal accounts.
      • Users are obligated to provide correct and up to date information. Users may revise, correct or update, from time to time, any information uploaded to their account, as long as any such updated information is correct.
      • Users are strictly prohibited from accessing the accounts of other users, revising any information uploaded to an account other than their own, providing personal information belonging to another person, or impersonating anyone other than themselves.
      • In uploading any material or information to the site, users must stick to the formats required by IE. Users will not include in the information or attachments they post on the site any of the following: (1) Any form of advertisement; (2) False or misleading information; (3) Any material protected under copyright; (4) Any term which may be construed as demeaning, discriminatory, sexually explicit, obscene, threatening, racist, derogatory, abusive, hateful or offensive to another person or entity; (5) Confidential information; (6) Anything the posting of which may infringe upon the intellectual property of another person or entity; (7) Any irrelevant (exposed or embedded) keywords.
      • The site is not a social media platform. Therefore, users may not respond to information uploaded by other users (except for job applicants who respond to job offers posted by employers, according to the site rules).
      • Users will be issued a personal password. The password is intended for personal use only and may not be shared with other users or divulged in any other way. Users are required to maintain appropriate and regularly updated data protection tools on their private computers or network. All users are responsible for all uses of their account, whether or not authorized by them. Any user who suspects that unauthorized or inappropriate use of their account had taken place should notify IE immediately.
      • Any breach of the above rules may result in the immediate cancellation of the user’s account without prior notice.

9.Applicable Law and Jurisdiction

 

  • Any legal question or dispute concerning this document shall be determined under the laws of the State of Israel and adjudicated before the courts of the city of Jerusalem (Israel).
